Premises Accident Resulting in a $7.3 Million Damage Verdict

Our client sustained nerve damage to her hand after falling due to an unsecured and raised canvas floor cover placed inside her home by furniture delivery men. She was holding a glass of water when she fell, so the glass shattered in her hand, resulting in lacerations and nerve damage.

The defendants’ argument was that the canvas was safely placed and that the furniture company was not responsible for the actions of the delivery men. The jury rejected this argument. However, the jury did find that the plaintiff was 65% comparatively negligent in causing the accident and so the verdict was reduced by this percentage.

The case was consequently settled for $750,000. This case was featured in the New York Law Journal.
